LEGAL & ACCOUNTING
MALPRACTICE ATTORNEYS

Atlanta, Georgia

Werdesheim & Newcomb, LLC’s practice is unique.

Prior to starting their own law firm, Pete and Billy were partners at a large, well-respected Atlanta defense firm where they worked together representing lawyers, accountants, and other professionals against malpractice allegations and other claims.  Their past experience defending professionals and working closely with their insurance carriers now provides them with an unrivaled advantage in evaluating and aggressively handling their clients' claims against those same types of professionals.

Pete and Billy listen carefully to their clients’ needs and narrowly tailor their litigation strategies to aggressively pursue those needs in the most efficient and effective manner possible.  They try cases.  They win motions.  They put their clients’ interests above their own.  Pete and Billy are dedicated to being among the best litigators in the State of Georgia.

Primary Practice Areas

  • For most of their careers, Pete and Billy have devoted the majority of their practice to legal-malpractice actions. They have handled malpractice claims and litigation arising from many different practice areas, from personal-injury cases to real-estate transactions to estate planning. Pete and Billy represent and consult with both plaintiffs and defendants and thus brings to each engagement a unique perspective, informed by experience with different types of clients, judges, juries, and insurance companies.

Pete and Billy have handled numerous accounting malpractice claims on both the plaintiff and defense side. They have worked on negligence and fraud matters arising from tax preparation, bookkeeping, compilation, audit, agreed-upon procedures, and trustee engagements. They know and attack the soft spots in the usual defenses asserted by accountants while also creating novel strategies to ensure the tortfeasors are held accountable for their bad acts.

  • Pete and Bill have represented many lawyers before the State Bar, from initial correspondence with the Office of General Counsel to matters before the Investigative Panel or where a formal complaint has been filed with the Georgia Supreme Court. Their practice has also included representation of attorneys and clients regarding fee disputes, sanctions motions, and abusive-litigation actions. To assist their attorney and law-firm clients with proactively avoiding such problems, Pete and Billy provide ethics opinions and analysis and consultations regarding issues as varied as conflicts of interest, E&O insurance, and attorney advertising.

  • Over the course of their careers, Billy and Pete have handled a wide variety of civil litigation cases in state and federal courts, including representing plaintiffs and defendants in personal injury and business litigation, policyholders and insurers in insurance coverage actions, various parties in contested probate matters, and designers, manufacturers, and distributors of numerous types of products.

  • W&N has significant experience drafting and negotiating commercial leases, asset purchase agreements, nondisclosure agreements, restrictive covenants, employment agreements, buy- and sell-side access letters, and other transactional documents. In that regard, the firm has represented a wide variety of businesses such as dental practices, transaction advisory firms, construction companies, interior design firms, and Pilates studios.
